Ordering, Delivery, Shipping and Returns

Please Read Before You Order

Deluxe Wine & Spirits Co. “DWS” does not sell, offer to sell or solicit sales of alcohol: our Service enables you to search online for alcohol and other products available for sale by licensed alcohol retailers that use DWS’s e-commerce service (“Retailers”).

The below order process, delivery, shipping and return policy are Service Policies of North Shore Food & Liquors ”NSFL”.

  • NSFL makes no warranties as to the inventory levels of any product!
  • Orders placed on the service are not purchased until accepted by NSFL’s employee or agent and a confirmation email sent to the client.
  • NSFL does not manufacture, bottle, produce or otherwise distribute any alcoholic beverages. All products are sold in the same or similar condition as received from distributor.

  • Product images are not of a specific item and are for display purposes only. Bottling and labeling may vary from an image and the actual product received. You must communicate with customer service before you place an order to confirm specific bottle information. Return costs for returns due to differences in bottle design are the reasonability of the customer.

  • Wine bottle vintages are substituted with the currently available vintage unless a customer requests a specific vintage and such vintage is readily available.
  • Orders are shipped free on board from NSFL’s premises.
  • Delivery can only be made to a person 21 years or older if you use delivery options offered on the DWS website. Shipping or delivery charges for any package returned to our stores for failed deliveries are not refundable.

If a buyer selects offered on the website delivery or shipping option, then he totally agrees not to place an order for shipping or delivery to any jurisdiction where transportation, possession, use, consumption, etc. of alcohol is prohibited by applicable to that jurisdiction law or ordinance.

ORDER:

Customer may place an order for shipping, where available, at customers sole own risk. Orders may not exceed 20 wine gallons or 150 lbs. on any domestic shipment, whichever comes first.

Customer may arrange own delivery services.(see CAP* option below) By Customer request DWS may try to arrange shipping on their behalf . In case DWS arranges shipping by Customer request, DWS shall reserve the right to reject or amend any order in our absolute discretion for any reason, including in the event of unavailability.

The automated service of DeluxeWineandSpirits.com website transmits orders to NSFL for review, acceptance and fulfillment. When an order is transmitted to NSFL, a unique order number will be assigned. NSFL will review your order and has the rights to accept or deny any order for any or no reason at all, including lack of inventory, inability to verify customer age or increased demand for a product. If items ordered are no longer in inventory after the order has been accepted, DWS’s customer service department will contact you after the department becomes aware when the products will become available. If you need to change your order for any reason, please contact the customer service department as soon as possible. Changes requested are not guaranteed. When you personally purchase any product in any NSFL’s store and would like your items to be shipped or delivered with a courier, express company or common carrier, please contact manager on the premises for details.

SHIPPING:

We are only able to ship to states which have laws that permit shipment of alcohol directly to consumers.

We do not warrant any shipping estimates although most shipments arrive within ten (10) days. Most orders ship in within two (2) business days. Customers will be notified of shipments taking longer than fifteen (15) days and be allowed to cancel their for full refunds. Customer non-response to such notifications shall be deemed as consent to continue with the order although we will strive to receive affirmative confirmation.
For delays longer than thirty (30) days, affirmative confirmation from the customer is needed. If the customer doesn’t consent, NSFL will automatically refund all the money the customer paid.
Finally, we have the right to cancel orders that NSFL can’t fill in a timely manner, but we will promptly notify the customer of our decision and make a prompt refund.
NSFL collects delivery charges when applicable and where available. The Service is not able to arrange any delivery (shipping) services.

Please note: DeluxeWineandSpirits.com and NSFL do not provide any delivery or shipping services of any alcoholic beverages. NSFL only fulfills and prepares orders for pick up or delivery arranged by customer. If an order cannot be fulfilled, the customer service department will attempt to contact customer via e-mail or phone. Deliveries or shipments may be delayed for a variety of reasons, including inclement weather and lack of courier availability. Available shipping options are displayed during checkout Customer is not required to use these shipping options and can arrange their own courier (see arrange your own shipping section below). Delivery time estimates is the time from pick up to delivery only. In general, delivery times may take from one to five business days.

Shipping States Wine*:

No Shipping Available to:
Alabama, Alaska, Arkansas, Delaware, Hawaii, Kentucky, Mississippi, Missouri, Oklahoma, Pennsylvania, Rhode Island, Utah and in all dry counties. However, if you live in one of these states and want to send a gift or shipment to an address outside of those listed above, you are able to do so.

Shipping States Spirits*:

Due to alcohol shipping regulations we are able to ship spirits only to the following states: Arizona, California, Colorado, Florida, Illinois, Indiana, Kansas, Louisiana, Maine, Montana, Nevada, New Jersey, New Mexico, New York, Ohio, South Carolina, Tennessee, Vermont, Virginia, Wisconsin and Wyoming, with the exception of dry counties.

*The laws regarding the direct alcohol shipments are constantly changing. We will expand our service area when laws permit and are optimistic that these restrictions will gradually disappear as consumer demand grows.

DELIVERY POLICY COMPLYING WITH APPLICABLE LAW:

Notice: delivery time estimates are not the time between when you placed an order and the time your order is delivered.

All orders where the billing address are different from the shipping address, or situations determined to be at a higher risk of fraud or illegal activity may be subject to additional verification.

If a customer selects delivery terms offered on the website, he warrants that shipment to and use in the provided shipping address is not in violation of any applicable law or ordinance. Tracking numbers, when applicable, are emailed to Customer after creation of shipping labels and not upon immediate order placement. When you receive an email that your order is being processed this does not mean that a package is actually picked up by delivery company or shipped.

Order Tracking: Tracking information, when available, can be viewed from your account in the DWS website.

Delivery options: . Alcoholic beverages cannot be delivered to the following address types: P.O. Box, APO/FPO addresses or any UPS/FedEx store or Postal Service.

Delivery rates: Delivery rates are automatically calculated based on weight and dimensions of the order. Specific items with unique size or shape may not be available for delivery or may incur additional packaging and delivery fees. Orders will only be delivered to physical addressed with signature of an individual 21 years or older. Alcoholic liquors can be delivered to a place of business or residence. Some collectible, rare, allocated or discontinued items cannot be replaced if an accident should happen.

Insurance: Additional insurance beyond the insurance offered by the carrier can be purchased. Principal will take reasonable precautions in safely packaging shipments to prevent breakage or mishandling.

DISCLAIMER:

All items are in new, factory sealed condition and exactly as they arrive to stores from distributors. All items are inspected before being prepared for delivery. Service administrators, principals, their employees or agents are not responsible for any defects in bottles, corks, caps, labels, or other product defects. Service administrators, principals, their employees or agents assume no liability for package content damage. Please be aware of shipping conditions before placing an order and make sure an adult 21 years or older is available to sign for the package. Any damage to packages by carrier in transit may be either reshipped or refunded only after a damaged package is returned to our premises and inspection of the damages is completed. Principals, their employees or agents make no representation to the legal rights of anyone to ship, use or import alcoholic beverages into or from any state or territory outside of Illinois. The customer is solely responsible for shipment of his/her alcoholic liquor. By placing an order and selecting available on the website delivery (shipping) options, customer authorize DWS to act on their behalf to engage a carrier for delivery of the order. Once package leaves NSFL’s premises, all concerns, complaints and issues with transportation and delivery are the responsibility of the carrier. Any and all issues with its service should be directed to the carrier.

WARNING: It is the sole responsibility of customer to inspect package upon delivery for damage. If the package arrives damaged, please inform customer service immediately. Clear evidence of damage including pictures of all boxes, bottles, etc. will be required to initiate investigation. It is Customers responsibility to notify DWS about damage as soon, as possible.

PAYMENT:

Receipt of Orders is not effective until accepted and confirmed by email. An order may be cancelled by Customer for a full refund any time before, but not after the order status is changed to Shipped. Cancellation by customer after the order is shipped shall be subject to Customer indemnifying us in full against all loss, damages, charges and expenses incurred to us, as a result of the cancellation.

Customer’s payment includes payment of the Product and shipping of the Product. NSFL reserves the right, by giving notice at any time before delivery of the Products, to increase the total amount of the Order price to reflect any increase in the cost due to any factor beyond NSFL’s control (such as, without limitation, any foreign exchange fluctuation, currency regulation, alteration of duties, significant increase in the costs of transportation), any change in delivery dates, quantities or specifications for the Order which is requested by Customer.. Customer will make payment of such amounts immediately upon demand by NSFL.

DELIVERY:

Any delivery date specified for delivery of the Products is approximate only. DWS and NSFL is not liable for any delay in delivery. If Customer fails to take delivery of the Products or fail to give DWS and NSFL adequate delivery instructions then, without prejudice to any other right or remedy available to us we may store the Products until actual delivery is completed and charge Customer for the reasonable costs (including insurance) of storage.

Insurance and Returns:

Your order is covered under standard insurance terms. Please closely inspect the package upon delivery before acceptance. Convincing evidence of any damage that occurred before delivery, but not after delivery takes place will be required. Please notify the delivery person of any damage and require him to document of the damage. NSFL will not provide a refund or exchange in respect of any Product ordered without clear evidence that the product was damaged during the transit.

CAP* (Customer- Arranged Pickup) Delivery with your choice of courier or delivery company:

You can use your own delivery services for any order meaning that you as the buyer may arrange a carrier of your choice to pick the goods up at the NSFL’s premises. NOTICE: Liability for any damage or loss that occurred during shipment to the buyer. CAP* can be arranged only from our store in Chicago, IL. We will not accept USPS. We will accept any express company, common or contract carrier that uses technology to facilitate the delivery of alcoholic liquor from licensed retail premises to consumers. If you arrange shipping for grain alcohol or any other liquor above 140 Proof/70% ABV., your shipping label must contain all proper wording and markers for hazardous/dangerous goods. Customer represents that CAP* complies with all applicable laws. You are not obligated to use shipping or delivery options of this website, or they might not be available for you.

WARNING: All orders that are not picked-up in the allocated period of time will be canceled and refunded, less packing and handling fees.

Illinois laws do not prohibit or prevent the possession and transportation of alcoholic beverages by the possessor for the personal use of the possessor, his family and guests. It is solely the responsibility of Consumers to check within their State, local and municipal regulations and ordinance to ensure compliance.

Buyer, his agent or broker acting as an agent may arrange carrier or delivery service of their choice. Buyer or his agent will be solely responsible for all labeling, pick up of the order from licensed premises and shipment or transportation of alcohol. Buyer must arrange pick up of his order in 10 (ten) business days from the time an order status is changed to available for pick up.

Title and ownership:

The fob terms do not need to be used. Title and ownership of all alcoholic liquors is transferred to purchaser in principals’ licensed premises in Illinois at the time the order is accepted by principal, the sale transaction is completed and the packaged order is loaded to carrier’s vehicle. Purchaser agrees to take full responsibility for any loss occurred during the transportation and/or delivery of the products. Any person or agent of private carrier must provide a valid form of identification that he is at legal age to possess and transport alcohol. Signature of such person or agent is required at the time of pick-up of an order. When order is accepted, purchaser or his agent must submit printable electronic shipping label coded as adult signature required to customer service via e-mail in all instances when common carrier is used. Any person who picks-up the order as an employee of a private carrier or delivery company must provide valid id and a copy of order invoice before he can pick-up the order. It is sole carrier or delivery company responsibility to verify upon delivery that purchaser is at legal age to receive alcohol. Purchaser must arrange all pick-up services by carrier or delivery company in the period of ten (10) business days after purchaser is notified that his order is accepted and order status changes to “awaiting pick up”. All orders that are not picked-up in allocated period of time will be canceled. All packing and handling fees are not refundable.

LOCAL DELIVERY: 

During shelter in place governor’s orders, orders will be accepted for local delivery by NSFL’s employee or agent through this automated service. All local delivery orders are subject to verification. As soon, as buyer is verified he/she will be added to verified customers group. All personal and confidential data received from buyer will be destroyed immediately.

All orders placed will be delivered next business day if possible but on some occasions it may take up to 2 business days, please check in advance if you need an urgent delivery.

No Saturday or Sunday deliveries at this moment but we can accommodate some upon request.

Pick-up in person from the store:

Pick up from NSFL’s Stores: You can use the automated Service of the Website and place an order for pick up at NSFL’s stores. Please allow at least 24 hours for your order to be processed. You will be contacted via email when your order is ready for pick up. Please have printed copy of invoice and valid ID ready when you or your assigned agent come to pick up the order.

To place an order using Order Pickup:

– Place an Order for pick up by adding item(s) to the shopping cart and select quantity (if applicable).
– Use a store address as the “shipping to” address to retrieve in store pickup option. – Proceed to checkout and submit order. If selected store doesn’t have the item available you will be notified by email provided by you, and unavailable item may be substituted or excluded from the order.
– Wait until you receive a pickup notification email before you go to the store to pick up your item. (This is a separate e-mail from your order confirmation.)
– Visit pickup location personally in the Customer Service section of the store or assign an agent/carrier to get your item(s).
– Age verification is required to pick up the order. Bring valid ID and copy of order invoice to the pick-up location.
– We’ll hold your items in the store for 5 business days (After 5 business days order will be canceled with refund. Restocking fee will apply.)

You can arrange a courier, express company or common carrier to pick-up and deliver your order to you. Principals are not liable for any damaged or missed/not delivered packages.

Please Notice: Orders may not exceed 150 lbs. for home delivery service. Records for all orders of 20 gallons of alcoholic liquor or more will be kept by Principal and provided to the Illinois Liquor Commission as required by law.

Return policy: We work hard to ensure the highest satisfaction of your expectations but there are no refunds allowed. Products delivered cannot be returned or exchanged unless otherwise stated herein.

ORDER CANCELLATION POLICY

Local Delivery Cancellation: If your order is accepted, but is not packed, then cancellation can be processed immediately. However, if your order has already prepared for delivery then a cancellation fee of $9.99 will apply. If your product is on the way for delivery and you would like to cancel your order a $19.99 restocking and cancellation fee will apply.

Shipping Order Cancellation: If your order is accepted, but is not packed, then cancellation can be processed immediately. However, if your order has already prepared for shipping then a cancellation fee of $9.99 will apply. If your product already shipped and you would like to cancel your order a $19.99 restocking and cancellation fee will apply plus additional return shipping charges from the shipping company.
